Terms of Service

By accessing or using TimedMail ("the Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the Service.

We reserve the right to update these Terms at any time. We will notify you of significant changes via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

TimedMail is a digital legacy service that allows you to:

• Create encrypted letters for designated recipients
• Set a check-in interval (7-365 days)
• Have letters automatically delivered if you stop checking in

The Service operates on a "dead man's switch" principle: letters are only delivered when you fail to check in within your specified interval.

All letter content is encrypted using AES-256-GCM combined with timelock cryptography via the drand (Distributed Randomness Beacon) network. This means your letters are mathematically impossible for anyone — including TimedMail — to access before the scheduled delivery time.

To use TimedMail, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We are not liable for any loss resulting from unauthorized use of your account.

When using TimedMail, you agree to:

• Use the Service only for lawful purposes
• Not use the Service to harass, threaten, or harm others
• Not include illegal content in your letters
• Not attempt to circumvent security measures
• Not use the Service for spam or unsolicited messages
• Maintain accurate recipient email addresses

We reserve the right to suspend or terminate accounts that violate these terms.

Your letters must not contain:

• Illegal content or instructions for illegal activities
• Threats of violence or harm
• Content that violates others' rights
• Malware, viruses, or malicious code
• Content that could be considered harassment

While your letter content is encrypted and we cannot read it, we may terminate accounts reported for abuse or violation of these guidelines.

You retain all rights to the content you create. By using TimedMail, you grant us a limited license to store, encrypt, and deliver your content as necessary to provide the Service.

The TimedMail name, logo, and all related trademarks are our property. You may not use our branding without written permission.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• All letters will be delivered successfully
• The Service will meet your specific requirements

We make reasonable efforts to ensure reliability but cannot guarantee perfect operation of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMEDMAIL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from delivery failures
• Damages exceeding the amount you paid for the Service

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless TimedMail, its officers, directors, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit through the Service

We reserve the right to modify, suspend, or discontinue the Service at any time. If we discontinue the Service entirely:

• We will provide at least 90 days notice
• All pending letters will be delivered to recipients
• Pro-rated refunds may be offered at our discretion

These Terms are governed by and construed in accordance with the laws of Iceland, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
